7th Circuit Decides in Favor of CCW

11-Dec-12 – 14:04 by ToddG

“The Supreme Court has decided that the amendment confers a right to bear arms for self-defense, which is as important outside the home as inside.”

— Judge Richard Posner writing for the majority in Moore v. Madigan

In a decision that surprised a number of people who’d been following the case closely, the Seventh Circuit Court of Appeals today reversed a lower court ruling and gave the Illinois state legislature six months to craft a concealed carry law. Rather than parrot what little I know about the decision already, I’ll let you follow the link and read for yourself.

Huzzah!

edited to add: The more I think about this, it’s really quite brilliant. By giving Illinois just 180 days to enact a CCW statute, it forces the state to put any appeal on the fast track. That means if it gets to the Supreme Court, it could happen very quickly… while we still have the same people on the bench who decided¬†Heller and McDonald.

  2. Only downside is, if Illinois is smart, they’ll copy New York’s legislation and say that they’re complying, while still denying permits to anyone who isn’t a politician or celebrity.

  3. I don’t think a reasonable reading of the decision would allow for such a law.

  4. Posner is one of the smarter judges around. His no-bs treatment of the software patent wars is how I know of him. I wish he would end up as the next Supreme.

  5. This is good news.

As someone who spent 20 years of their life in the Chicago suburbs enjoying some solid friendships during that time, I wish the folks in IL the best.

  6. I just moved to Chicago. I don’t doubt the city itself is going to end up like NYC, but I can maybe hope for a while. I work in a rough area and definitely miss being able to carry.
